Using your Social Network Profile(s)
Everyday Models are a responsible media agency. We strive for innovative ways in which our members earn money while living there daily lives.
Everyday Models encourage our members to act in accordance with the rules and regulations of any social networking site to which they may be a member, including respecting the rights of any third party, copyright, trademark, privacy, publicity or any other person or property rights and to never use libellous, defammatory or otherwise unlawful material.
Should any member decide of their own volition to use their social network profile(s) for economic benefit we positively discourage the behaviour of directly 'tagging', 'associating' or in any way 'linking' friends to a photograph or any other content. Such behaviour is considered a breach of our terms and an infraction on our policy of responsible advertising.
If, as a member of Everyday Models, you choose to modify your social network profile(s) in such a way as to benefit from our innovative advertising methods, you do so at your own risk, acknowledge the decision to do so as your own, and that we have at no time been given access to your profile(s) in which to make any modifications.
We do not accept any responsibility for loss, damages or inconvenience caused as a result of modifications made to your social network profile(s).
Working for an Everyday Models Client
In working for an Everyday Models Client you agree that you are not an employee, agent or partner of ours and that you will not make any such assertions. You confirm and agree that no employment relationship is intended and understand and agree that we are not an employment agency.
If through our site we should provide a mechanism for payment to you directly by an Everyday Models Client, you and the Everyday Models Client will be responsible for the discharge of any liability to taxation and for the payment of national insurance contributions in respect of all fees and other sums payable to you.
Termination
You may terminate your membership by giving notice to us at support@everydaymodels.co.uk.
We may also terminate your membership early without notice if you fail to comply with these terms and conditions or our Website Use Policy.
Waiver
Any waiver, delay or failure in our enforcing or requiring compliance of any term or provision of these terms or of our terms of website use shall not prevent us from subsequently requiring compliance with any such term or provision.
Severability
If any term or provision of these Agency terms and conditions of our terms of website use are held to be unenforceable, in whole or in part, then the validity and enforceability of the remaining terms or provisions shall not be affected.
Third Party Rights
These terms shall not be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not party to them.
Force Majeure
We shall not be liable to you in respect of anything that may constitute breach of this agreement arising by reason of force majeure including (without limitation) fire, flood, accident, acts of terrorism, telecommunications and utilities failure, civil unrest, riot, war, act of God, the act of any government or authority (including refusal or revocation of any licence or consent), theft, malicious damage and any cause or circumstance whatsoever beyond our reasonable control.
Applicable Law and Jurisdiction
The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms are governed by English law.
